PRESS PLAY: COPYRIGHT OFFICE RESPONDS TO MIDJOURNEY & HER LITTLE “AI” FRIENDS
In case you’ve been living under a rock you know that Errybody and they mama are treating ChatGPT MidJourney, and DALL-E like Sonny from iRobot.
Business owners are leveraging AI-tools to build website, workbooks, and wealth with greater ease and efficiency.
Some say it’s CREEPY how savvy these tools are while others think it’s INCREDIBLE.
And you wanna know what I think as an attorney?
I’M HERE FOR IT
Leveraging technology has AH-MAZING benefits especially for small business owners who don’t have the capital or capacity to scale up with a large team.
Using AI to help write books, create presentations, cut videos, generate social media posts is a smart move.
But, I had to ask…
CAN YOU REALLY PROTECT AI-GENERATED CREATIVE WORKS?
The Copyright Office says NO.
Recently, they revoked a prior-issued registration for comic book that used MidJourney (an AI tool)
OK SO BOOM…
Creator Kris Kashtanova used MidJourney to create the images in her comic book, Zarya of the Dawn.
But…her use of Artificial Intelligence was NOT disclosed in the initial application.
So, how DID the Copyright Office find out about her use of MidJourney?
Ms. Kashtanova shared on social media about the “big fun” she had using MidJourney to create her comic and it came to the attention of the Copyright Office.
Whew, they snatched that registration with the quickness and told the applicant IT AIN’T NEVER gonna happen.
Ms. Kashtanova was issued a new registration for the writing so ALL was not as this was a product of “human authorship”.
Do you think the Copyright Office got this one right or wrong family?
